Participant(s)/You/Your

The Quiz is open only for Participant(s) who (i) are between eight (8) to eighteen (18) years of age as on Quiz Date; (ii) are citizen of India residing in India; (iii) guardian/parent/supervising adult of such Participant(s), are/is a Active Tata Sky subscriber from which the Quiz is played and (iv) enters the Quiz in accordance with the terms and conditions, rules mentioned below. All the above conditions are mandatory for an individual to qualify to be a Participant.

Eligibility

1. The Quiz is open only to those Participant(s), whose guardian(s), parent(s), supervising adult have an Active Tata Sky connection at the time of participation, through which the Participant(s) may participate in the Quiz.

2. The following persons cannot participate in this Quiz:

Employees and relatives of:

a. Tata Sky:

b. Quiz partners (if any) and its affiliates.

c. Tata Sky business associates including it?s dealers and advertising agencies and Anyone else who is involved in the actual process of conducting the Quiz.

Tata Sky reserves the right, at any time, to verify Eligibility requirements, in any manner deemed appropriate by Tata Sky.

Periodicity of Choosing Winners: After the Quiz Date.

Prize: Top ten (10) winners will win Rs. 2 Lakhs each.

In the event of You choosing to participate in the Quiz, in addition to the terms and conditions stipulated in the Specific Terms and Conditions of Tata Sky Subscription Contract and / or Specific Terms and Conditions of Tata Sky Subscription Contract for Tata Sky Hardware provided on Entrustment basis (hereinafter, collectively referred to as the ?Subscription Contract?) and / or Everywhere TV Terms and Conditions (?EWTV T&C?), if applicable, You shall be bound by the Terms and Conditions contained herein this ?Quiz Document?.

Process of participating in the Quiz

To participate in the Quiz, select Tata Sky Scholarship option which will be hosted under the Active Electronic Program Guide (EPG) listing of Tata Sky.

Participants/guardian/parent/supervising adult of such Participant (who is Active Tata Sky subscriber), having mobile phone connection of all mobile operators can SMS the code. The cost of SMS would be Rs. 3 per SMS shall be solely borne by the Participant(s) and /or guardian/parent/supervising adult of such Participant.

On selecting the Quiz option, your television screen will display fifty (50) multiple choice questions with four (4) answer options, which will be edutainment based questions formulated from topics like history, geography, science, logical reasoning, general knowledge, politics and civics, English language from infotainment/edutainment channels and from general knowledge which is available on Actve services of Tata Sky like Actve Fun Learn, Actve Vedic Maths and Actve English.

The questions and answer would be combination of: (a) text based questions and possible answers and / or (b) image and text based question and text based answer, and / or (c) audio and text based question and text based answer, and / or (d) Grid and text based question and text based answer, (e) crossword and text based question and text based answer, and / or (f) vedic maths questions and possible answers and / or (g) image and text based question and image based answer.

The Quiz will be conducted in English language only.

From the time of logging in the Quiz, you will have 30 minutes time to answer all the questions.

If you answer all the questions within the aforesaid 30 minutes, a submit option will be shown on your TV screen. Similarly, if you are not able to answer all the questions within the aforesaid 30 minutes, a code will be generated on your television screen.

There will be an option to skip any question in case you are not sure of the answer. However, you can revisit the skipped question(s) after attempting all the remaining questions but before the 30 minutes timeframe of the Quiz. However, answers to the questions are submitted they cannot be revisited.

You need to SMS the aforesaid code to 56633 on the Quiz Date itself. Responses sent after the Quiz Date shall not be considered and shall be null and void.

Your may send as many entries as you wish however only first entry of yours would be considered.

You must SMS your code to 56633 which will be available on your TV screen till the time you press the red button on your Tata Sky remote.

Wrong code sent by SMS from your end will not be considered.

Every correct answer will be given 10 points, every wrong answer will get negative 3 points, every unanswered question will give 0 points.

If you like to exit/quit participation in the Quiz at any point of time you can press red button on your Tata Sky remote control. However, you will not be allowed re-participate in the Quiz. On quitting the Quiz you shall not be entitled to the Prize.

Selection of the winners

At the end of Quiz, guardian/parent/supervising adult (who have an active Tata Sky connection via which the Quiz is played) of the Participant who has provided the maximum number of correct answers with minimum amount of time taken, will qualify to become a winner.

Top ten (10) guardian(s)/parent(s)/supervising adult(s) (who have an active Tata Sky connection) Participant(s) of whom have answered the questions with the least time taken will be declared as winners.

The results generated will be final and binding on the Participants and the guardian(s)/parent(s)/supervising adult(s) (who have an active Tata Sky connection).

General Terms and Conditions:

Charges for SMSs are subject to change as per each individual operator?s prerogative and Tata Sky is not responsible for the same. Tata Sky shall use its best endeavors to regularly update the charges in case there is any change in the charge for SMS.

Tata Sky shall not be responsible in case of any technical issues, network problems such as breakdown of machinery, unclear network, disruption in the network and/or the cost of the SMSs charged by the network operator. Any dispute in connection to the same shall be settled between the Participant(s), the guardian/parent/supervising adult of such Participant and the network operator without involving Tata Sky in any manner whatsoever.

The Participant and guardian/parent/supervising adult of such Participant should not have any civil or criminal conviction or should not be bound by any contract or agreement that would not permit the Participant and guardian/parent/supervising adult of such Participant from participating in the Quiz.

The guardian/parent/supervising adult of such Participant, who has Active Tata Sky subscriber from which the Quiz is played is registered with a network operator shall be eligible to participate in the Quiz.

The winner shall be informed/contacted by Tata Sky. Selected winners shall be invited to collect the Prize at the Venue decided by Tata Sky. If the selected winner resides outside Mumbai, the winner shall be provided with economy class Air Travel for travelling on the dates as specified by Tata Sky. Accommodation and local travel shall be at the Participant and the winner?s sole costs, charges and expenses.

The Participant and the guardian/parent/supervising adult of such Participant must submit to Tata Sky a copy of the last two bills issued by the network operator as a proof that the mobile number is registered in the name of the Participant and / or guardian/parent/supervising adult of such Participant and such other documents that could be furnished as proof that the mobile number is registered in the Participant?s and / or guardian/parent/supervising adult.

The winner along with the Participant must be present at the venue (specified by Tata Sky) and on the date and time as specified by Tata Sky to collect the Prize otherwise the Prize shall stand cancelled/withdrawn by Tata Sky.

Winner will have to submit the proof of age and proof of residence (i.e., Birth Certificate, 10th Class leaving Certificate/ School certificate/ passport/ ration card, an affidavit signed before a magistrate) of himself/herself along with the Participant. For supervising adults of the Participants, it is mandatory to provide a No Objection Certificate of the parent of the Participant.

Tata Sky reserve all rights to make amendments to the existing Quiz without prior notice or withdraw the Quiz without prior notice for any reason whatsoever.

Non-conformance by any Participant and the guardian/parent/supervising adult of such Participant (who has a Active Tata Sky subscriber from which the Quiz is played) of the rules of the Quiz will disqualify the Participant and the guardian/parent/supervising adult of such Participant (who has a Active Tata Sky subscriber from which the Quiz is played) from participation, immediately.

The Participant(s) and guardian/parent/supervising adult of such Participant (who has a Active Tata Sky subscriber from which the Quiz is played) agree that he/she shall make himself/herself available from time to time and co-operate with Tata Sky and participate in any activity and/or campaign (Promotional Activity) of any nature whatsoever without any money payable to the Participant and/or guardian/parent/supervising adult of such Participant (who has a Active Tata Sky subscriber from which the Quiz is played). Further, the Participant(s) and/or guardian/parent/supervising adult of such Participant (who has a Active Tata Sky subscriber from which the Quiz is played) agree that the footage of any nature with regard to the them shall vest with Tata Sky, including but not limited to all intellectual property rights and any other rights for worldwide and in perpetuity.

The Participant and the guardian/parent/supervising adult of such Participant (who has a Active Tata Sky subscriber from which the Quiz is played) hereby understands and gives his/ her irrevocable consent to Tata Sky for exchange and/or sharing of personal information with any third party organizers and/or its vendors including without limitation publish and/or communicate to/in any media that it may deem fit, and Tata Sky and/ or its vendors may, at their sole discretion choose to publish or disclose the name, phone number and if required

Further, participation of the Participant(s) and the guardian/parent/supervising adult of such Participant (who has a Active Tata Sky subscriber from which the Quiz is played) in Quiz shall be construed that the Participant(s) and the guardian/parent/supervising adult of such Participant (who has a Active Tata Sky subscriber from which the Quiz is played) has waived her/his right to file in person and/or through any family member and/or third party any applications, criminal and/or civil proceedings in any courts or forum against Tata Sky.

Tata Sky shall not in any manner whatsoever be responsible and/or liable in any manner whatsoever, for any physical injury, death, mental trauma caused to the any of the Participant(s) and/or guardian/parent/supervising adult of such Participant (who has a Active Tata Sky subscriber from which the Quiz is played) or any person related to them, in any manner whatsoever, including but not limited to in relation to the Quiz.

Any and all taxes and/or levies applicable under the laws of India shall be borne by the Participant(s) and /or guardian/parent/supervising adult of such Participant (who has an Active Tata Sky subscriber from which the Quiz is played) in relation to the participation and Prize.

All Participant(s) and the guardian/parent/supervising adult of such Participant(s) (who has a Active Tata Sky subscriber from which the Quiz is played) shall do any and all acts and execute any and all documents in such manner and at such location as may be required by Tata Sky in its sole discretion to protect, perfect or enforce any of the rights granted or confirmed to Tata Sky herein.

Participants and the guardian/parent/supervising adult of such Participant(s) (who has an Active Tata Sky subscriber from which the Quiz is played) agree to abide by the terms and conditions, participation rules including the general rules.

Participation of the Participant(s) in the Quiz shall be construed that the Participant(s) and guardian/parent/supervising adult of such Participant(s) (who has a Active Tata Sky subscriber have waived his/her/their right to dispute any decision(s) made by Tata Sky in connection to Quiz and that the Participant(s) and/or guardian/parent/supervising adult of such Participant(s) (who has a Active Tata Sky subscriber agrees to all the decision(s) made by Tata Sky and that all the decision(s) shall be final and binding upon the Participant(s) and guardian/parent/supervising adult of such Participant(s) (who has a Active Tata Sky subscriber.

Tata Sky reserves the right to take such action as deemed fit if it is found by Tata Sky that any information provided by the Participant(s) and the guardian/parent/supervising adult of such Participant(s) (who has a Active Tata Sky subscriber is wrong or any misrepresentation is made by the Participant(s) and/or guardian/parent/supervising adult of such Participant(s) (who has a Active Tata Sky subscriber).

Tata Sky reserves the right to, cancel, discontinue, prematurely withdraw, change, alter or modify this Quiz or any part thereof including the Eligibility criteria, the Terms & Conditions at their sole discretion at anytime during its validity as may be required in view of business exigencies and/or changes by regulatory authority and/or statutory changes and the same shall be binding on the Participant and the guardian/parent/supervising adult of such Participant(s) (who has a Active Tata Sky subscriber).

For the Participant participating in the Quiz, it shall be construed that the Participant(s) and guardian/parent/supervising adult of such Participant(s) (who has a Active Tata Sky subscriber) has undertaken to indemnify and keep Tata Sky the Channel, including its affiliates, directors, officers, partners, employees, consultants, agents etc. harmless and indemnified against any loss, damage, claims, costs and expenses including but not limited to legal fees and other charges which may be incurred or suffered by Tata Sky, including its affiliates due to breach of any terms and conditions contained herein by the Participant and the guardian/parent/supervising adult of such Participant (who has a Active Tata Sky subscriber) and/or infringement or violation of any patent, copyright, trademark, trade secret or other proprietary right of a third party by the Participant and guardian/parent/supervising adult of such Participant (who has a Active Tata Sky subscriber), and / or arising from the participation of the Participant and guardian/parent/supervising adult of such Participant(s) (who has a Active Tata Sky subscriber) in the Quiz.

The terms and conditions contained herein and/or, any other rules and regulations in respect of the Quiz may be amended at any time without any notice, without assigning any reason and without any liability whatsoever. The Participants and the guardian/parent/supervising adult of such Participant(s) (who has an Active Tata Sky subscriber) are requested to refer to such other terms and conditions, if any, which may be displayed on the website of Tata Sky. However, no obligation is cast on Tata Sky to separately intimate each individual Participant and the guardian/parent/supervising adult of such Participant(s) (who has Active Tata Sky subscriber) with regard to such additional terms and conditions.

The participation of the Participant(s) in the Quiz shall mean that the Participant(s) and the guardian/parent/supervising adult of such Participant(s) (who has a Active Tata Sky subscriber) has read, understood, accepted and agrees to abide with all the rules including the general rules of the Quiz.

Any Participant and the guardian/parent/supervising adult of such Participant (who has an Active Tata Sky subscriber) who manipulates the Quiz in any manner whatsoever shall be liable for disqualification at the sole discretion of Tata Sky. In such event Tata Sky shall not be liable to consider even a valid entry sent by the Participant the guardian/parent/supervising adult of such Participant (who has a Active Tata Sky subscriber) thereafter.

The payment of the Prize will be made within a period of sixty (60) days from Quiz Date and shall be subject to deduction of applicable withholding taxes (at present 30%) as per Indian Income Tax Laws. Tata Sky will deliver the necessary withholding tax (TDS) certificates in accordance with the provisions of the Income Tax Act, 1961, to the registered address of the guardian/parent/supervising adult of such Participant(s) (who is Active Tata Sky subscriber). The guardian/parent/supervising adult (who is Active Tata Sky subscriber) of such Participant(s) is required to furnish relevant documents to enable Tata Sky to release the cheque and TDS certificate in the name of the parent/supervising adult (who is Active Tata Sky subscriber via whose account the Quiz is played). It is mandatory to provide clear and legible PAN card copy of the winner i.e the guardian/parent/supervising adult of such Participant(s) (who is Active Tata Sky subscriber). The Tata Sky subscriber whose account the Tata Sky Scholarship quiz has been played has to be present along with the Participant to collect the cheque.

The winners will be responsible for any other relevant taxes arising from the receipt of the Prize. You agree to indemnify Tata Sky against any claims incurred by Tata Sky on account of failure on your part to discharge your tax liabilities on the Prize.

Tata Sky reserves the right at anytime, without prior notice, to add or vary all or any of these terms and conditions or to replace, wholly or in part this Quiz or to withdraw it completely.

Tata Sky will not be liable for any loss, damage or cancellation of this Quiz caused by events beyond its reasonable control including war, natural calamities, floods, failure of telecommunication network, etc.

Participant(s) and guardian/parent(s)/ supervising adult of such Participant(s) (who is an Active subscriber of Tata Sky) consent to comply with these terms and conditions and waive any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless Tata Sky and its respective affiliates, advertising and promotion agencies, and its respective agents, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from participation in the Quiz including but not limited to any misuse of the prize by the winner.

You acknowledge and agree that all disputes in relation to the Quiz shall be subject to sole and exclusive jurisdiction of courts located in Delhi, India.

Tata Sky is not responsible for printing or typographical errors in any Quiz related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error.

By conducting this Quiz, Tata Sky is not in any manner whatsoever, directing you to opt for the products and services of Tata Sky.

The Quiz is void where prohibited or restricted by law, and is subject to all applicable mandatory local laws.
